  • Platform: The online marketplace operated by The Finlancer Global Inc to connect Freelancers and Employers.
  • Freelancer: A professional offering services on the Platform.
  • Employer: An individual or entity seeking services on the Platform.
  • Order: A contract initiated between a Freelancer and a Employer for specific services.
  • Admin Fee: A service fee charged by the Platform to Professionals for using the Platform.

2. Account Registration and Identity Verification

2.1 Account Creation: Both Freelancers and Employers must create accounts with accurate and up-to-date information.
2.2 Identity Verification: All Freelancers must complete identity verification. This includes submitting government-issued identification and other documentation as required by the Platform.
2.3 Tax Documentation:

  • Freelancers residing in the U.S. must submit a completed W-9 form. Failure to submit the required tax documentation may result in delays or 30% Tax withholding of payments.
  • Freelancers outside the U.S. must submit a completed W-8BEN form.

3. Fees and Payments

3.2 Payment Process for Freelancers:

  • Payments for completed Orders will processed once project is delivered, accepted and completed.

3.3 Payout Methods: Professionals must ensure their payout method is up-to-date and compliant with the Platform’s requirements. Processing fee may apply based on the payment methods chosen by the freelancers available on the platform.

4. Freelancer Responsibilities

  • It is the freelancer’s responsibility to submit accurate withdrawal requests on time.
  • Any errors or delays caused by incorrect information provided by the freelancer may result in additional processing time.

5. Dispute Resolution

  • Any disputes related to payouts must be submitted via our support system within 7 days of the payout processing date.

6. Dispute Resolution

6.1 Dispute Filing Window:

  • Disputes must be raised within 7 days of Order delivery.
  • After 7 days, Orders will be deemed accepted, and payments will be processed to Freelancers.

6.2 Dispute Resolution Process: The Platform provides mediation services to resolve disputes between Freelancers and Employers. The Platform’s decision on disputes is final and binding.

7. Responsibilities of Freelancers and Employers

7.1 Freelancers:

  • Deliver services as per the agreed-upon scope and timeline.
  • Ensure compliance with local laws, including tax reporting obligations.
  • Maintain accurate tax documentation and account information.

7.2 Employers:

  • Provide clear instructions and necessary materials for Orders.
  • Raise disputes within the designated 7-day period, if applicable.

8. User Conduct and Prohibited Activities

Users agree not to:
8.1 Provide false or misleading information.
8.2 Circumvent the Platform’s admin fees or payment systems.
8.3 Use the Platform for Illegal Activities.
8.4 Engage in harassment or unprofessional behaviours.

9. Limitation of Liability

The Platform is not liable for:

  • Losses arising from services delivered by Professionals.
  • Delays or errors in payment processing due to incomplete documentation.
  • Disputes not raised within the 7 days of period.
  • We do not hire. We are not employers. The services you get from thefinlancer.com are offered by independent freelancers and professionals. We highly recommend you to check the profile skill set of the service provider before you subscribe to their services. We do our best to make sure that you get the best possible services at thefinlancer.com. In case of any disagreement, dispute, or any issues with the service providers, feel free to reach us using any of the available communication channels.

9. Termination of Accounts

The Platform reserves the right to suspend or terminate accounts for violations of these Terms or failure to comply with identity verification or tax documentation requirements.

10. Governing Law and Jurisdiction

These Terms are governed by the laws of the United States of America.

11. Amendments

The Platform may update these Terms at any time. Users will be notified of significant changes, and continued use of the Platform constitutes acceptance.
